If you decide to sell your park home, you have the right to sell either privately, through an Estate Agent or through the Park Owner. Out of courtesy we would advise you to tell your Park Owner as soon as you have made this decision. You never know, he/she may offer to buy the home from you, thus eliminating the trauma of finding your own customer and they may also hold a waiting list of potential customers for you to tap into. In some cases, existing residents may have signed a Written Statement, where they are obliged to offer their home to the Park Owner in the first instance. Recent legislation has found this an unacceptable Condition of the Agreement and is no longer valid, even retrospectively. All new Agreements under the Mobile Home Act 1983 will not be able to place an obligation for the park homeowner to offer it to the park owner initially. Park Owners in membership of either the British Holiday and Homes Park Association and the National Park Homes Council will permit one "For Sale" notice to be displayed in the window of a home for sale, provided that it does not exceed A4 size (210mm x 297mm) (8.25 inches x 11.75 inches). However, the Park Owner may have a professional "For Sale" sign for you to borrow - do ask. A hand written "For Sale" sign sometimes, doesn't have the same appeal!!!! You must consult with the Park Owner, as he/she is required to give consent to your prospective buyer, without withholding consent unreasonably and a decision must be given within 28 days. The Law now requires the Park Owner to respond in writing, giving or refusing approval. If the approval is withheld, the reasons must also be given in writing. As soon as time allows the Department of Communities and Local Government have intimated that government will legislate to require a private vendor to give their purchaser a copy of their agreement under the Mobile Home Act 1983 at least 28 days before the sale. If your purchaser needs to move in sooner, they may do so, but you would be wise to ask your purchaser to sign a waiver. Ask your Park Owner for advice. Under the Mobile Homes Act 1983, the Park Owner is entitled to a commission on the assignment of the Agreement. Currently this assignment commission is 10%.
